Offer Terms and Conditions for Amazon Home Electronics Sale

1. This offer ("Offer") is provided by American Express Banking Corp ("Amex") and is made available on www.amazon.in and the mobile application and mobile site thereof (collectively "Amazon.in") by Amazon Seller Services Private Limited ("Amazon").

2. These Offer terms and conditions ("Offer Terms") are in addition to Amazon.in Conditions of Use & Sale and Privacy Notice to which you agree to by using Amazon.in. In the event of any conflict between the Conditions of Use & Sale and these Offer Terms, these Offer Terms will prevail, only for the purposes of this Offer.

3. All residents of India holding a valid and current credit card(s) issued by Amex ("Card") are eligible to avail the Offer.

4. The Offer is valid from July 27, 2017 to July 30, 2017 (both days inclusive) ("Offer Period"), or until stocks of the Products (defined below) on Amazon.in last, whichever is earlier, unless revoked or extended by Amazon in its sole discretion, or revoked by Amex, without any prior notice and without liability.

5. Under this Offer, any Cardholder who, during the Offer Period, purchases any of the following new products: (a) television, (b) washing machine, (c) refrigerator, (d) microwave; (e) air-conditioner (each a "Product") from any seller on Amazon.in worth INR 8,000 or above, on a per transaction basis, and makes the payment of the purchase transaction (of the Product) using the Card, will be entitled to receive a cashback to the tune of 10% (ten percent) of the list price of the Products (as determined by the relevant seller) as Amazon Pay balance in the Amazon.in account of the Cardholder.

6. Each Cardholder can avail a maximum cashback of INR 2,000 (Indian Rupees two thousand only) per Card, irrespective of number of purchases during the Offer Period.

7. The purchase of the Product(s) on Amazon.in will be governed by the terms of sale, including terms of exchange, applicable to the sale of the Product on Amazon.in.

8. The Offer is valid on multiple transactions for the aforementioned Products, subject to a minimum purchase amount of INR 8,000 (Indian Rupees eight thousand only) for each such transaction made by the Cardholder during the Offer Period. Each Cardholder will only be entitled to a maximum cashback amount of INR 2,000 (Indian Rupees two thousand only) per Card under this Offer. For the avoidance of doubt, it is clarified that in the event a Cardholder makes multiple purchases of the Product during the Offer Period using the Card and the amount of each of such transactions exceeds INR 8,000 (Indian Rupees eight thousand only), the Cardholder will only be entitled to a maximum cashback of INR 2,000 (Indian Rupees two thousand only) per Card.

9. This Offer will also be applicable on purchase of Products by the Cardholders under an exchange offer (if available and applicable on the Products). For the avoidance of doubt, it is hereby clarified that 10% (ten percent) cash back will be provided to the Cardholders under this Offer on the net value paid i.e. the price paid by the customers after the exchange offer has been availed such value should be a minimum of INR 8,000 (Indian Rupees eight thousand only). It is hereby clarified that the Cardholder will only be entitled to a maximum cashback amount of INR 2,000 (Indian Rupees two thousand only) per Card.

10. The cashback amount provided to eligible Cardholders under this Offer is being funded by Amex, to the total exclusion of Amazon.

11. This Offer will not be applicable if the Cardholder or seller or Amazon cancels the order and/or returns the Product and in such a case, participation in the Offer will be deemed withdrawn.

12. Amex reserves the right to disqualify the Cardholders from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer or otherwise by use of the Card.

13. Amazon reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary any or all of these Offer Terms or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.

14. Delinquent and over-limit Cardholders will not qualify for this Offer.

15. The Cardholders are not bound in any way to participate in this Offer. Any such participation is purely voluntary. The Offer is being made purely on a best effort basis.

16. Nothing herein amounts to a commitment by Amex or Amazon to conduct further any similar or other offers.

17. The above Offer is by way of a special offer and nothing contained herein shall prejudice or affect the terms and conditions of the card member agreement. The terms of the above schemes shall be in addition to and not in derogation of the terms contained in the card member agreement.

18. All disputes between the Cardholders and Amex will be resolved inter se and Amazon will not (nor will be liable or obliged to) mediate or resolve any dispute or disagreement between the Cardholders and Amex.

19. This Offer is not valid on corporate or commercial credit Cards issued by Amex.

20. To be eligible for the Offer, the entire payment for the purchases of the Product(s) on Amazon.in will need to be made exclusively through the Card only. This Offer is not available on (i) purchase of products other than the Product(s), or (ii) purchase of Products using a card other than Card(s) or where multiple payment methods are used to complete a purchase transaction.

21. The relevant Amazon Pay Balance will be credited in eligible Cardholders' Amazon.in account by Amazon by September 30, 2017.

22. Under no circumstances will the cashback being offered under this Offer be settled in cash in lieu by Amex or by Amazon.

23.
